Terms of Use
These Terms of Use govern access to and use of the AKLARIS website, its content, forms and features. They apply to the public website and do not replace a services agreement signed with a client for an AKLARIS project.
The website is intended primarily for businesses, executives and professionals, including in the United States, Europe, the United Kingdom, the United Arab Emirates and other international markets. Mandatory local rules applicable to a user continue to apply where they cannot be contractually excluded.
1. Publisher and purpose of the website
AKLARIS is an entity in the process of formation, published and operated by Niangadou Malick Souleymane Ange Junior. Business address: Abidjan, Cocody Angré 8e tranche, Côte d’Ivoire. Website: https://aklaris.com.
2. Acceptance of the Terms
By accessing the website or using its features, you accept these Terms to the extent permitted by applicable law. If you do not accept them, you must stop using the website.
Where an action requires express acceptance, AKLARIS may request additional confirmation of the applicable terms.
3. Information only — no contractual offer
Information, examples, budget ranges, timelines, methods, case studies and service descriptions on the website are provided for information only. Unless expressly stated, they are not a firm offer, quotation or contractual commitment by AKLARIS.
Each client engagement is subject to a separate agreement, such as a proposal, Statement of Work, Project Agreement or other signed contract. In case of conflict, the signed client agreement governs the relevant project.
4. Accuracy and commercial communications
AKLARIS seeks to present its services, capabilities and content clearly and accurately. Content may change, however, and information may become incomplete or outdated.
Statements about conversion, credibility, positioning or business opportunities describe objectives, an approach or possible outcomes. They do not guarantee revenue, traffic, leads, ranking, funding or future performance.
5. Intellectual property
Unless otherwise stated, the website, its architecture, text, graphics, concepts, animations, interfaces, illustrations, videos, editorial content, distinctive signs and other original elements are protected by applicable intellectual property rights and belong to AKLARIS or are used under licence.
You may view the website for legitimate professional or personal purposes. Without AKLARIS's prior written permission, you must not:
- reproduce, publish, distribute, resell or commercially exploit a substantial part of the website;
- substantially copy or imitate AKLARIS's creative direction, text, concepts, case studies or proprietary systems;
- remove or alter copyright, trademark or attribution notices;
- use the content to create a competing product, service or offering without permission.
Client or partner trademarks, logos and content shown in case studies remain the property of their respective owners.
6. Prohibited uses
You agree not to use the website to:
- commit or facilitate unlawful, fraudulent or abusive activity or infringe others' rights;
- gain or attempt unauthorized access to the website, its servers, accounts, data or systems;
- introduce malware, disrupt the website or bypass its security measures;
- conduct penetration tests, vulnerability scans or attacks without written permission;
- impersonate another person or knowingly provide misleading information;
- mass-collect or automatically extract content abusively or to reconstruct the website;
- use AKLARIS content to train or commercialize an artificial intelligence system where legal authorization is required but has not been granted.
These restrictions do not limit uses authorized as a matter of mandatory law.
7. Forms and information submitted
When using a form, you agree to provide reasonably accurate information and only content you are authorized to share.
Submitting a form does not guarantee acceptance of a project, AKLARIS's availability or the creation of a contractual relationship. Personal data submitted through the website is processed as described below.
8. Third-party links and services
The website may contain links, integrations or content from third-party services. AKLARIS does not necessarily control those services and is not responsible for their content, availability, security practices or privacy policies. Use of a third-party service may be subject to its own terms.
9. Availability, security and changes
AKLARIS may change, suspend, correct or remove all or part of the website at any time, including for maintenance, security or improvement. AKLARIS takes reasonable steps to keep the website accessible and secure but does not guarantee continuous availability or complete freedom from errors, viruses, vulnerabilities or interruptions.
10. No professional advice
Website content is not legal, tax, financial, accounting, regulatory or investment advice. Businesses should obtain professional advice suited to their circumstances where necessary.
11. Disclaimer of warranties
To the fullest extent permitted by applicable law, the website and its content are provided 'as is' and 'as available'. AKLARIS disclaims implied warranties that may legally be disclaimed, including fitness for a particular purpose, uninterrupted operation and absolute accuracy of all content.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded in the relevant jurisdiction.
12. Limitation of liability
To the fullest extent permitted by applicable law, AKLARIS is not liable for indirect, consequential or special losses arising solely from use of, or inability to use, the website, including lost opportunity, profit or data.
This limitation concerns the public website. Liability for a client project is governed by the signed project agreement. Nothing limits liability that mandatory law does not allow to be excluded or limited.
13. International users
AKLARIS operates internationally, and the website may be accessed from the United States, the European Union, the EEA, the United Kingdom, the United Arab Emirates and other countries. Each user must comply with the laws applicable to them when accessing the website.
These Terms are designed for a primarily B2B activity. They do not remove mandatory rights applicable in a user's jurisdiction. Where a provision conflicts with a mandatory rule, that rule prevails to the strictly necessary extent.
Market-specific points
- United States: no provision permits misleading commercial communications or removes non-waivable federal or state rights;
- European Union / EEA / United Kingdom: applicable mandatory protections, particularly for personal data and, where relevant, consumer rights, remain reserved;
- United Arab Emirates: electronic use of the website and interactions with AKLARIS remain subject to applicable mandatory rules on electronic transactions and communications.
14. Data protection and cookies
Collection and use of personal data, cookies and similar technologies are described in the policies below. The website currently uses no non-essential analytics or marketing tools.
15. Governing law and disputes
Subject to applicable mandatory rules, these Terms are governed by the law of the Republic of Côte d’Ivoire and, where relevant, applicable OHADA Uniform Acts.
Before litigation arising from website use, the parties are invited to seek an amicable solution for fifteen (15) days from written notice of the dispute.
If no amicable resolution is reached, the competent courts of Abidjan may hear the matter, unless a mandatory rule assigns jurisdiction to another court. Client contracts may provide different arrangements, which govern the relevant project.
16. Changes to the Terms
AKLARIS may update these Terms to reflect changes to its services, website, organization or legal framework. The version published on the website is the version in effect.
17. Severability and no waiver
If a provision is held invalid or unenforceable, it will be limited or set aside only as necessary, without affecting the remaining provisions. AKLARIS's failure to exercise a right immediately is not a waiver of that right.
